Privacy Policy

This Privacy Policy explains how Remember Studios, Inc. ("Ember," "we," "us," or "our") collects, uses, shares, and protects information when you use Ember on the web, in the iOS app, or through related services (collectively, the "Service").

1) Our Privacy Commitments

• You own your recorded memories, audio transcripts, uploaded photos, and videos. We provide storage for them in the cloud, and provide you with tools so that you can generate derivative content, like images, videos, written stories from your memories.
• We do not sell your personal information.
• We do not use your private content to train generalized AI models unless you separately opt in.
• We do not use cross-app tracking for advertising unless you separately opt in.
• We share your content only as you direct, such as with Circles or public shareable links, or as needed to provide, secure, and comply with the Service.

2) Information We Collect

Account and profile information

We collect information you provide when creating or using an account, such as your name, email address, phone number, profile details, authentication data, support messages, and account settings.

Memories, recordings, and user content

Ember is built to help you preserve your memories. We collect content you choose to create, upload, record, or save, including voice and audio recordings, audio transcripts, images, videos, notes, stories, edits, tags, titles, Circle memberships, comments, invitations, files, and other materials you provide.

Permissions and device features

Our iOS app may request access to your microphone so you can record audio, your camera and photo library so you can attach photos and videos, your contacts so you can find, invite, or connect with people you choose, notifications so we can send account and product updates, and biometric or device authentication so you can enable an on-device app lock. If you grant contacts permission, we use contact information only to provide the invite, discovery, or connection feature you request. Biometric authentication is handled by your device operating system; Ember does not receive or store your Face ID, Touch ID, or biometric template.

Payment and subscription information

If you purchase paid features, we may receive limited billing status, plan, entitlement, renewal, cancellation, and transaction information from payment providers such as Stripe, Apple, or RevenueCat. We do not store full payment card numbers.

Usage, device, and diagnostics

We collect technical information such as app version, browser type, operating system, device identifiers, IP address, approximate location inferred from IP address, language, timestamps, log data, crash reports, performance diagnostics, and interactions with the Service. Where available, you can manage optional analytics and diagnostics in the app or device settings; we may still collect information needed to operate, secure, debug, and comply with the Service.

Communications and messaging

If you use verification, invitation, or notification features, we process email addresses, phone numbers, delivery status, routing metadata, timestamps, message logs, and message content as needed to send those communications.

3) How We Use Information

We use information to:

• provide, operate, maintain, and improve the Service,
• record, transcribe, summarize, organize, and generate stories from memories,
• process audio, photos, attachments, and other content you submit,
• authenticate users and secure accounts,
• support Circles, invitations, sharing, reporting, blocking, and moderation,
• send transactional communications, push notifications, verification codes, account notices, and support responses,
• manage subscriptions, billing, refunds, entitlements, and purchase history,
• debug, analyze, and improve reliability, performance, and product experience,
• protect against fraud, abuse, security incidents, and prohibited content,
• enforce our Terms and Community Guidelines, and
• comply with legal obligations.

4) AI Processing and Model Training

Ember uses automated processing and AI systems to provide product features such as transcription, summarization, image generation, topic generation, story drafting, editing, search, moderation support, and quality checks.

We may send your content to AI service providers, including Google Vertex AI or Gemini and similar US-based service providers, only to provide and secure the Service under our instructions. We do not use your private content to train generalized AI models unless you separately opt in.

AI outputs may be inaccurate or incomplete. You should review generated content before relying on it or sharing it.

5) Sharing and Circles

You control who can see your content inside Ember. You may share content with Circles, individual invitees, or public URL links. You may also revoke sharing permissions after sharing content. People you share with may be able to view, save, copy, or further disclose content, so share carefully.

We may disclose content when necessary to provide sharing features, process reports, enforce our rules, comply with law, or protect rights, safety, and security.

6) Push Notifications, Cookies, and Analytics

If you enable push notifications, we process push tokens and related device metadata to deliver notifications. You can manage notification permissions through your device settings.

We use cookies and similar technologies for core site functionality, session management, preferences, security, analytics, and performance. Analytics tools may help us understand aggregate usage and product quality. We do not sell personal information or use cross-app tracking for advertising unless you separately opt in.

7) How We Share Information

We use service providers and processors to operate Ember. They process information on our behalf and under contractual restrictions. These providers may include:

• cloud hosting, storage, database, CDN, and infrastructure providers,
• AI, image generation, and transcription providers, including Google Vertex AI or Gemini and similar US-based services,
• communications providers, including Twilio,
• payment and subscription providers, including Stripe, Apple, and RevenueCat,
• security, crash, observability, and analytics providers, including Sentry, PostHog, and Customer.io,
• customer support, email, product operations, and compliance tooling.

We may also share information with other users when you direct us to do so, with authorities or third parties when legally required or necessary for safety and security, and in connection with a merger, acquisition, financing, reorganization, or sale of assets.

8) Data Retention and Account Deletion

We keep information for as long as needed to provide the Service, comply with law, resolve disputes, enforce agreements, prevent abuse, and maintain security.

If you request account deletion, Ember starts a 30-day recoverable grace period. During that period, you may recover the account by signing back in. We revoke active sessions and begin disabling account access. After the grace period, or once irreversible deletion work begins, the deletion cannot be recovered.

Some information may be retained where required or appropriate for legal, tax, accounting, chargeback, fraud prevention, trust and safety, security, audit, backup, or dispute-resolution purposes. Deleted data may remain in encrypted backups for a limited period before it is overwritten or purged.

9) Your Choices and Rights

You can manage account details, sharing choices, notification permissions, contacts access, app permissions, optional analytics or diagnostics where available, and deletion choices through the Service or your device settings.

Depending on where you live, you may have rights to access, correct, delete, export, restrict, or object to certain processing of your personal information. To make a privacy request, contact privacy@ember.build. We may verify your identity before responding.

10) International Processing

We and our providers may process information in the United States, South Korea, and other countries where we or they operate. We use safeguards designed to protect information consistent with applicable law.

11) Children's Privacy

The Service is intended for users who are at least 13 years old, or the minimum age required in their jurisdiction. We do not knowingly collect personal information from children under 13.

12) Security

We use administrative, technical, and organizational safeguards designed to protect information. No system is completely secure, and we cannot guarantee absolute security.

13) Changes to This Policy

We may update this Privacy Policy from time to time. We will update the effective date and provide additional notice where required.
